General Terms and Conditions – PALMO

1. Scope of Application

These general conditions apply to all orders placed by consumers through PALMO's online store.

According to § 13 BGB, a consumer is any natural person who performs a legal transaction for purposes that are not primarily attributed to their commercial or independent professional activity.


2. Formation of the Contract

The presentation of products in the online store does not constitute a legally binding offer, but an invitation to place an order.

By clicking the “Buy now” button, you place a binding order for the products included in the cart.

The purchase contract is formed when we confirm your order by email or when we ship the product.


3. Prices and Payment Terms

  • All prices are in euros (€) and include the applicable VAT.

  • Additional shipping costs are clearly shown during the purchase process.

  • Available payment methods:

    • Credit card

    • PayPal

    • Shopify Payments

    • Other methods shown at checkout

Payment is immediate upon conclusion of the contract.


4. Delivery

  • Delivery is made to the address provided by the customer.

  • The delivery time is indicated on each product page.

  • If a product is not available, we will inform you immediately.

  • The risk of accidental loss passes to the customer upon delivery of the product.


5. Retention of Title

The products remain the property of PALMO until full payment is made.


6. Right of Withdrawal

Consumers have the right of legal withdrawal.

7. Warranty

The legal warranty rights according to Spanish/European law apply.
In case of defects, you have the right to additional performance (repair or replacement).


8. Liability

We are liable without limitation for:

  • Intent and gross negligence

  • Damage to life, body, or health

In case of slight breach of essential contractual obligations, liability is limited to foreseeable and typical contract damage.
In other cases, liability is excluded.


9. Dispute Resolution

The European Commission offers an online dispute resolution platform (ODR).
We are neither obligated nor willing to participate in proceedings before a consumer arbitration board.


10. Applicable Law

Spanish law applies, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).


11. Final Provisions

If any provision of these Terms and Conditions is wholly or partially invalid, the validity of the remaining provisions shall not be affected.
